A Power of Attorney (Poder Notarial) is necessary if you want another person to represent your interests in Spain: signing documents, buying or selling property, applying for a residence permit, obtaining a TIE, dealing with taxes or carrying out legal procedures.
We help you execute a power of attorney with a notary public on a turnkey basis: we prepare the text, explain the type of power of attorney, make an appointment with the notary and accompany you to the issuance of the document.

Why should you execute a power of attorney with us?

Selecting the right type of power of attorney for your legal situation

In Spain there are several types of powers of attorney: general, special, procedural, financial, for buying/selling real estate, for receiving documents. We determine which type is right for you, so that the document is 100% suitable for your task and legally valid.

Spanish notaries work according to strict wording. If the wording of the power of attorney is not correct, the notary will reject the document. We write the text in legal language that is accepted by notaries throughout Spain.

We make an appointment with a notary in Barcelona, agree a date, prepare the documents, accompany you to the meeting and make sure that the power of attorney is executed correctly and without errors.

We organize the process remotely: the power of attorney can be issued through a consulate or a foreign notary with an apostille. We give detailed instructions and check the document before submission in Spain.

We create powers of attorney for real estate, opening bank accounts, applying for residence permits, TIE, obtaining documents, representation at the tax office, court, police and city hall.

How to execute a Notarial Power of Attorney in Spain

The execution of a power of attorney (poder notarial) is a legal procedure that requires precise text, correct authority structure, correct identification of the parties and compliance with Spanish notarial law.
We provide a complete cycle, from determining the right power of attorney format to obtaining a notarized document valid in Spain or abroad.

1. Consultation and selection of the right type of power of attorney for your task

We analyze your situation in detail:
– do you need to buy real estate, sign bank documents, apply for a residence permit or get a TIE?
– do you need a general power of attorney or a special one?
– do you need to include authority to file documents with migration, banks, police?
– do you need a power of attorney for courts (poder para pleitos)?

Based on the task, we select the optimal power of attorney format, so that the document is legally flawless and gives your representative precise powers – no less and no more than necessary.

2. Drafting a legally correct power of attorney in Spanish

Spanish notaries use very strict legal wording. Incorrect wording is a common reason for refusing to execute a power of attorney.

We are:

  • we draft the text according to the standards of the Spanish notary public,

  • spell out all the powers in detail and correctly,

  • include possession, management, representation, deed signing, filing, banking authority, pre-migration presentation, etc.,

  • agree the text with the notary in advance, so that he accepts the document without comments.

This ensures that the power of attorney acts exactly as you intend.

3. Preparation of all documents for the notary

To execute a power of attorney, we prepare:

  • passport or NIE of the principal,

  • the details of the authorized person,

  • supporting documents for specific authorities (real estate, company, migration),

  • pre-application and confirmation of enrollment,

  • a sale or lease agreement (if a power of attorney for the transaction),

  • resident’s current documents (if the power of attorney includes migration powers).

We verify all data to avoid misspellings of names, dates, document numbers – any mistakes can lead to legal consequences.

4. Entry to the notary and accompaniment to the execution of the power of attorney

We will arrange an appointment with the notary, coordinate a time and prepare you for the visit.
At the meeting, we:

  • present with you,

  • check that the text of the power of attorney is correct,

  • explaining every line of the document,

  • control the verification of the identity and data of the trusted person,

  • make sure the document is properly authenticated and sealed by a notary public.

You receive a legally valid power of attorney without errors or defects.

5. Executing a power of attorney outside Spain: consulate or foreign notary public

If you are outside Spain, a power of attorney can be made:

at the Spanish consulate

The document will be valid in Spain without an apostille, as the consulate acts as a Spanish notary.

foreign notary

In this case, the document must be apostilled in order for it to be legally valid in Spain.

We are:

  • prepare the text of the power of attorney for your notary,

  • check the document before signing it,

  • give precise instructions as to which apostille is required,

  • explain how to send the document to Spain and how to present it to a notary or the authorities.

This is critical: without an apostille, the power of attorney will be considered invalid in Spain.

6. Receipt of power of attorney, data verification and final instructions

After checkout, we check in:

  • correctness of first and last name,

  • NIE/NIF correctness,

  • authority included in the document,

  • the presence of all the notary’s seals and signatures.

We also explain where and how to use a power of attorney:
– at the notary,
– at the bank,
– in migration,
– at the police,
– when buying real estate,
– when filing taxes or documents.
